Lenox Inc. Offers a 50 Year Limited Warranty on Burial Vaults
-TERMS OF LIMITED WARRANTY –
The LENOX TRIGARD Burial Vault described on the face hereof will protect the casket and its contents from damage caused by normal earth pressure and from damage due to the entrance of water from the outside into the vault providing said vault has been properly installed and sealed by the Manufacturer or its designated representative. This warranty is invalidated if said vault has been moved after burial, or if the vault has been damaged by blasting in the cemetery or other unnatural acts, or if the vault has been damaged by the use of machinery on adjoining graves, or by an act of God.
If the vault is so defective, the Manufacturer will, within ten days after receipt of the claim to the Manufacturer, without charge, replace the above vault with a new burial vault of the same kind. Notice of any intended disinterment of the above burial vault shall be given to the Manufacturer above named at least forty-eight hours in advance and a representative of the Manufacturer shall have the right to be present at the disinterment. Any claim of defect shall be filed with the Manufacturer at the address shown above within thirty days of date of disinterment. This warranty certificate must accompany claim and the Purchaser agrees to allow the Manufacturer to repossess the defective vault at the Manufacturer’s expense.
All express warranties not set forth above are hereby disclaimed and expressly excluded. Except to the extent prohibited by applicable law, all implied warranties, including the warranties of fitness and merchantibility, hereby disclaimed and expressly excluded to the extent such warranties may run beyond the duration of this limited warranty which will be in effect for fifty years from date of interment. The Purchaser’s sole remedy is against the Manufacturer under the terms of this warranty. The seller makes no warranty of fitness or merchantibility, express or implied. Except as stated herein, in no event shall the Manufacturer be liable for any special consequential, incidental or other damages, whether on the basis of contract, tort, strict liability or otherwise.
Some states do not allow limitations on how long an implied warranty lasts and some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
